Terms of Service

1. Acceptance of Terms

By downloading, installing, or using BioAge ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the App. These Terms constitute a legally binding agreement between you and the developer of BioAge.

BioAge is rated 9+ on the App Store. If you are under 13 years of age (or the applicable age of digital consent in your country), you must have your parent or guardian read and agree to these Terms on your behalf before using the App. By using the App on behalf of a minor, a parent or guardian represents that they have the authority to bind the minor to these Terms and accept full responsibility for the minor's use of the App.

2. Not a Medical Device — No Medical Advice

BioAge is a personal wellness tracking tool for informational and educational purposes only. It is NOT a medical device and has NOT been cleared or approved by the U.S. Food and Drug Administration (FDA), CE-marked under the EU Medical Device Regulation, or certified by any other health regulatory authority.

BioAge does not:

• Provide medical diagnoses or clinical assessments
• Constitute the practice of medicine, nursing, or any other licensed health profession
• Replace professional medical advice, diagnosis, or treatment
• Predict, detect, or monitor any medical condition or disease

ALWAYS seek the advice of a qualified healthcare provider with questions you may have regarding a medical condition. NEVER disregard professional medical advice or delay seeking it because of information provided by this App. In a medical emergency, call emergency services immediately.

3. License Grant

Subject to these Terms, BioAge grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial wellness tracking purposes, in accordance with Apple's App Store Terms of Service.

4. Restrictions

You may not:

• Reverse engineer, decompile, disassemble, or attempt to derive source code from the App
• Use the App for commercial purposes or to provide health services to third parties
• Distribute, sublicense, rent, lease, or lend the App
• Use the App in any manner that could damage, disable, overburden, or impair it
• Attempt to gain unauthorised access to any systems connected to the App
• Use the App to provide medical advice, diagnosis, or treatment to others
• Remove or alter any proprietary notices, labels, or marks on the App

5. User Responsibilities

You are solely responsible for:

• The accuracy and completeness of health data you enter
• Maintaining the physical security of your device
• Consulting qualified healthcare providers before making any health or medical decisions based on App results
• Complying with all applicable laws and regulations in your jurisdiction
• Protecting any data you export from the App
• Safeguarding your Anthropic API key if you configure AI Insights

6. AI-Generated Insights Disclaimer

The AI Insights feature uses Anthropic's Claude AI to generate personalised commentary based on your health scores. AI-generated insights:

• Are not reviewed or validated by medical professionals
• May be inaccurate, incomplete, or inappropriate for your individual circumstances
• Do not constitute medical advice or a clinical opinion
• Should not be used as the sole basis for any health-related decision

Use of the AI Insights feature is entirely at your own risk. BioAge expressly disclaims all liability for any harm arising from reliance on AI-generated content.

7. Intellectual Property

The App, including all software, algorithms, scoring models, user interface designs, and content (excluding your personal health data), is the exclusive property of the BioAge developer and is protected by copyright, trade secret, and other intellectual property laws. These Terms do not grant you any rights in BioAge's intellectual property other than the limited license in Section 3.

8. Data Ownership & Processing Consent

You retain full ownership of all health data you input into BioAge. By using the App, you grant BioAge permission to process your data locally on your device to compute biological age scores.

If you explicitly enable AI Insights and provide consent, you additionally authorise BioAge to transmit anonymous numeric scores (as described in the Privacy Policy) to Anthropic's API for insight generation. This authorisation may be revoked at any time in Settings → Privacy → AI Insights.

If you enable Daily Auto-Import, you authorise BioAge to access Apple HealthKit in the background approximately once per day to read sleep and HRV data. This access is read-only and revocable at any time.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or free of harmful components
• Warranties regarding the accuracy, reliability, or completeness of biological age estimates or health scores
• Warranties that the App will meet your specific requirements or expectations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIOAGE OR ITS DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF BIOAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BioAge's total aggregate liability to you for all claims shall not exceed the amount you paid for the App in the twelve months preceding the claim (or USD $5 if the App was provided at no charge).

11. Indemnification

You agree to defend, indemnify, and hold harmless BioAge and its developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App in violation of these Terms; (b) your violation of any applicable law or regulation; (c) your reliance on App-generated health scores or AI insights for medical decisions; or (d) your infringement of any third-party rights.

12. Third-Party Services

BioAge integrates with Apple HealthKit and Anthropic's Claude API. Your use of those services is governed by their respective terms of service and privacy policies. BioAge is not responsible for the availability, accuracy, or practices of any third-party service. In the event of any conflict between these Terms and the requirements of Apple's App Store Review Guidelines or Developer Program License Agreement, Apple's terms shall prevail with respect to Apple's services.

13. Termination

BioAge may terminate or suspend your license to use the App immediately and without notice if you breach these Terms. Upon termination, your right to use the App ceases. You may cease using the App at any time and delete all your data via Settings → Privacy → "Delete All My Data".

Sections 2, 7, 9, 10, 11, 14, 15, and 16 survive any termination of these Terms.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of courts of competent jurisdiction. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. No Waiver

BioAge's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision shall be effective only in writing.

16. Changes to Terms

BioAge may revise these Terms at any time. Material changes will be notified in-app. The effective date at the top reflects when the current version took effect. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
